Elizabeth Holmes is denied request to stay out of prison

It looks like Elizabeth Holmes has finally reached the end of the road. Recently, a federal judge has denied the disgraced former CEO of failed health tech company Theranos’ request to stay out of prison as she awaits her sentencing.

Holmes was indicted earlier this year on two counts of fraud for allegedly lying about Theranos’ blood-testing technology, which was intended to be revolutionary but in reality performed rudimentary tests and was never commercially viable. In the wake of her indictment, the US Department of Justice did not recommend a sentence and Holmes’ attorney argued that she could stay out of prison as she awaited her sentencing.

However, Judge Edward J Davila of the Northern District of California ruled that an exception should not be made for Holmes and that she would need to serve time in prison during the sentencing process. He stated that Holmes’ crime had demonstrated a “greed of obtaining wealth and prestige at the risk of other people” and that “justice is best served” by immediately incarcerating Holmes.

The judge did, however, agree to loosen the terms of Holmes’ pretrial release. Holmes had been ordered to wear an ankle monitor and remain in her mother’s San Francisco home, but the judge agreed to release her to the custody of her father in Washington state. It is also worth noting that Judge Davila did not actually set a date for Holmes’ prison sentence or give any indication as to how long she may be in prison.

For now, Holmes will have to stay under the supervision of her father and await the ruling of the judge. It’s unclear at this point how long she may be in prison but it is certainly likely that this is the end of the road for her. The only question now is how much time she will have to spend behind bars for her alleged crimes.
