The potential appears to be enormous. AI systems can churn through vast amounts of data, making them well-suited to parsing through mounds of text looking for potentially libelous language. This could mean simpler and more efficient ways to detect libel, as well as a more effective way to ensure that legal requirements are met.
At the same time, however, AI systems are only as accurate as their algorithms. However, just because AI can detect libel doesn’t mean it can effectively eliminate it. In the end, the decision about what constitutes libelous speech will still largely be left up to human judgment, as courts must still decide whether a statement qualifies as libel or not.
At the same time, this doesn’t mean AI can’t be useful in deciding libel cases. While no AI system has been tested in court yet, it may be possible for AI to provide useful assistance by analyzing facts and identifying portions of text that contain potentially libelous material.
Ultimately, the way AI is utilized to identify and potentially even commit libel will depend on the legal structure of each individual jurisdiction. As AI systems become more advanced, legal systems must attempt to stay one step ahead, but only time will tell whether AI can play a meaningful role in libel law.
